If you downloaded from Kodi.tv, no need to worry about virii. I have seen this behaviour for years, at least in windows.
It would be better if the installer didn't get flagged as I have seen many remarks about it.

Now for your question about subtitles, does the following not work?

-start a video
-go to setting-subtitles
- untick enable subs
- select set as default at the bottom

To summarize, in my personal view (which is in no way the norm as I have not a complete overview of all possible situations), the ideal way for it to work, would be:

1. Kodi acts only on the forced flag=on the track itself (i.e. on the container level), not on possible forced subtitles inside the track. VLC Player and PowerDVD also seem to work that way.
2. If a subtitle track is forced, it will always be displayed. It cannot be turned off and in particular will no be listed in the subtitle settings. If there exist multiple subtitle tracks with the forced flag=on, only one is chosen by some default mechanism. If that would result in an undesired choice, it can always be altered with MKVPropEdit. 
3. Non-forced subtitle tracks can always be switched on and off, even if a subtitle track contains a number or only forced subtitle entries. Non-forced subtitle tracks are always listed in the subtitle menu and only one (or none) can be selected at any given time. The toggle switch to turn off non-forced subtitle tracks, should always be functioning for the listed subtitle tracks. VLC Player and PowerDVD also work that way.

The situation where a subtitle track on a dvd contains a number of forced subtitle entries (as mentioned in 3.) poses no issues in the case of .MKV files as MakeMKV purportedly (I have no actual experience with that) will recognize the situation where a subtitle track on dvd has a mix of forced and non-forced subtitles and in that case provides an option (a checkbox that can be selected) which will create two seperate containers (tracks) for them, one container with flag forced=on, the other with forced=off.

That all sounds logical. As I don't really use subtitles of any kind that much, my answer was quite basic. I just disabled and never see them with mentioned method. Of course, there are many variants with sources and differently marked subs. Maybe CastagnaIT will see your post and can say something useful about it, as that's the dev that does a lot in this area for Kodi.

New build to test. This time is Omega based and can be installed on top of current v21.1 (and keep same version number 21.1):

The logic is simplified and also applied when settings changes in middle of playback (contextual menu).
Now even if subtitle is default enabled (due MKV container flags) should be possible disable after from contextual menu.

When subtitle is disabled and language not matches with audio language, stream is totally closed (the forced ones should not be visible either).
