As for kodi's trademark, the first question as always is whether people could reasonably think it's an official kodi mag. I'd guess that would be a pretty clear 'yes' given the front cover, whatever disclaimers are inside. But it's just a guess. It's not "KODI" magazine. It's name is "The Complete Guide KODI". Even with "KODI" accentuated on the cover doesn't make it any more questionable. These guys aren't stupid. So unless that blue Kodi logo is trademarked and "The Complete Guide KODI" usage of it does NOT fall under some fair use legal clause, they are probably home free. True, the size/usage of logo on the cover might be stretching it, but I'm not sure. Maybe anyone can dig up prior court decisions for similar cases? They only seem to stock it in the larger Sainsburys stores around my area. Telling people how to use BitTorrent is different because it does not automatically imply that it's use will be for illegal means. By promoting the installation of addons that are almost exclusively for the purposes of illegal streaming comes under a raft of UK laws and so could easily be subject to prosecution. Just as there are no magazines that can tel you how to construct a bomb or pick a lock. |
